Welcome to Root & Harvest, a community for gardeners, farmers, homesteaders, producers, and people who want to learn, share, and connect locally.
These Terms of Use (“Terms”) govern your use of the Root & Harvest website and mobile app, including community features and purchases made through them (the “Services”). The Services are owned and operated by Membr Systems LLC, a Texas limited liability company (“Root & Harvest,” “we,” “us,” or “our”).
Please read these Terms before creating an account, posting content, or making a purchase. By affirmatively accepting these Terms, you agree to be bound by them. If you do not agree, do not create an account or use features requiring acceptance.
Questions may be sent to support@rootandharvest.app.
1. Eligibility and accounts
You must be at least 18 years old and legally able to enter into this agreement to create an account or use the member community.
You agree to provide accurate account information, keep it reasonably current, and protect your login credentials. You may not impersonate another person, misrepresent your authority to represent a business, or use another person’s account without authorization.
Notify us promptly if you believe your account has been compromised. You are responsible for your own use of the Services and for activity you authorize through your account; this does not make you automatically responsible for unauthorized activity beyond your control.
2. Permission to use the Services
Subject to these Terms, we grant you a limited, nonexclusive, nontransferable permission to access and use the Services for their intended purposes.
You may use community and business-directory features as offered, but you may not resell access, bypass access restrictions, scrape member information without authorization, interfere with the Services, or exploit them for unlawful purposes.
The website and app may offer different features. Features may change over time, subject to your purchase rights and applicable law.
3. Community standards
Help keep Root & Harvest welcoming, useful, and respectful. You may not use the Services to:
- Harass, bully, threaten, stalk, or intimidate anyone.
- Promote hatred, violence, or discrimination against protected groups.
- Post sexually explicit content or content that exploits or endangers children.
- Commit fraud, promote scams, impersonate others, or make misleading claims.
- Send spam, repeated unwanted messages, or unauthorized mass promotions.
- Publish another person’s private or sensitive information without permission.
- Upload content that infringes copyright, trademarks, privacy, or other rights.
- Post illegal content or promote unlawful goods, services, or activities.
- Upload malware, attempt unauthorized access, or disrupt the Services.
- Evade an account restriction or misuse reporting and blocking tools.
- Collect or use member information for unsolicited marketing.
Members may upload photos, posts, and comments using the available features. Video uploads are not supported.
Business listings and promotional content must accurately describe the business and its offerings. A listing is not an endorsement, certification, or guarantee by Root & Harvest.
4. Member content and ownership
You retain ownership of the content you submit. You are responsible for ensuring that you have the rights and permissions needed to share it, including permission for any personal information or images of others it contains.
By submitting content, you give Membr Systems LLC a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, and display that content only as reasonably necessary to operate and provide the Services. This includes allowing service providers to process content on our behalf for those purposes.
This license respects the audience of the feature in which you share content. It does not authorize us to make private messages public or to use member content in advertising.
We will request separate permission before featuring your content or personal information in marketing.
The license ends when your content is removed from our systems, except to the extent limited retention or processing is legally required. It does not require other people to return copies they independently saved or override legal obligations.
5. Visibility, messages, and privacy
Events and news are publicly accessible. Other community content is available to signed-in members according to the relevant feature. Private messages are intended for their conversation participants.
Our Privacy Policy separately explains how we collect and handle personal information, including location, photos, messages, analytics, and account deletion. Acceptance of these Terms is not blanket consent to optional marketing or other processing that requires separate permission.
Do not share information you do not want the intended audience to see. We cannot prevent recipients from copying or sharing information they receive.
6. Reports, blocking, and moderation
You can report user-created content and block users through the app. You may also contact support@rootandharvest.app about misuse or safety concerns.
We may review reported content that is available to us and take appropriate action, including removing content, restricting features, or suspending or terminating accounts. Root & Harvest administrators cannot review private conversations through the administration tools. If you report an incident involving messages, provide relevant details or evidence that you are authorized to share.
We may act without advance notice when reasonably necessary to address serious violations, security risks, legal requirements, or threats to safety. Where appropriate, we will explain the action. You may contact support to request a review.
We do not promise to review every post before it appears. Our moderation rights do not eliminate any obligations imposed on us by applicable law.
7. Products, tickets, and payments
Products and event tickets sold through the Services are sold by Membr Systems LLC through Root & Harvest administrators. Members do not sell products or tickets through the platform’s checkout. Root & Harvest is not operating a member-to-member marketplace.
Payments are processed through Stripe. You must be authorized to use the payment method you provide.
The applicable price, currency, taxes, shipping charges, and any additional charges will be disclosed before you complete a purchase. Product availability, supported delivery destinations, and event availability may vary. Worldwide availability of the community does not mean every product ships worldwide.
We may decline or cancel an order for legitimate reasons such as unavailable inventory, suspected fraud, legal restrictions, or a material listing error. If we cancel an order after collecting payment, we will refund the amount paid for the canceled items and any associated charges that must be refunded. We will not charge a higher price without your agreement.
No recurring subscription charge is authorized merely by creating an account or making a one-time purchase. Any future subscription would require separate disclosure and acceptance.
8. Shipping and delivery
Physical products are shipped using UPS or FedEx. Available shipping options, costs, destinations, and any stated shipment or delivery estimates will be provided during ordering.
You must provide accurate delivery information. Information needed to fulfill an order, including the delivery address, must be provided to the carrier handling the shipment. Please contact us promptly if an address needs correction.
We will comply with applicable shipment deadlines and rules concerning delays, cancellation, and refunds. Where required, we will notify you of a delay and obtain your agreement to wait or provide the required cancellation and refund option.
If an order arrives damaged, is incorrect, or appears to be lost, contact support@rootandharvest.app with your order details. We will work with you and the carrier to address the issue. Use of an outside carrier does not remove our responsibilities to you as the seller.
9. Returns and refunds
Root & Harvest administrators handle return and refund requests. Contact support@rootandharvest.app with your order number and a description of the issue.
Any additional product-specific return conditions must be disclosed before purchase. These may address eligibility, return periods, item condition, return shipping, and any lawful exceptions for particular goods.
Nothing in these Terms limits mandatory rights concerning defective, damaged, misdescribed, or undelivered goods, or any applicable statutory cancellation rights. A discretionary return policy does not override those rights.
10. Event tickets and participation
Event listings will describe the event and any applicable attendance requirements. Review those details before purchasing a ticket.
Ticket transfer rules, purchaser cancellations, rescheduling, and event cancellation terms must be disclosed before purchase. If we cancel or materially change an event, we will communicate the available options and provide any refund or other remedy required by the applicable purchase terms and law.
Follow reasonable venue, organizer, and safety instructions. You are responsible for considering whether an activity is appropriate for your abilities and circumstances. This provision does not waive rights or excuse negligence or other liability that cannot lawfully be excluded.
11. Member advice and local connections
Members may share experiences and information about gardening, farming, homesteading, food preparation, preservation, animal care, and related subjects. Member contributions may be incomplete, inaccurate, or unsuitable for your situation.
Evaluate information before relying on it. Seek qualified advice when an activity involves health, food safety, veterinary care, chemicals, machinery, legal requirements, or other specialized risks. A member’s post does not become professional advice from Root & Harvest merely because it appears in the Services.
Use reasonable care when meeting people or visiting businesses discovered through the community. Member profiles and listings do not constitute verification or endorsement. These provisions do not reduce our obligations for products or tickets we sell.
12. Our intellectual property
The Root & Harvest name, logo, software, interface, and content created or licensed by us are protected by applicable intellectual property laws. Except as permitted by law or these Terms, you may not copy, sell, distribute, or create derivative works from them without permission.
To report suspected infringement, email support@rootandharvest.app with a description of the protected work, the location of the disputed content, your contact information, and an explanation of your rights or authority to act.
13. External services and links
The Services may link to third-party websites, business pages, or social media accounts. Those services are governed by their own terms and privacy practices.
We do not control independent third-party content. However, using Stripe, UPS, FedEx, or another provider to fulfill our own sales does not turn those sales into transactions with independent member sellers or eliminate our seller responsibilities.
14. Availability and changes
We aim to keep the Services useful and available, but interruptions may occur for maintenance, technical problems, security issues, or circumstances outside our reasonable control.
We may modify or discontinue features. Where a change materially affects paid obligations, we will provide appropriate notice and any remedy required by law. We will not use feature changes to retroactively remove rights associated with an existing purchase.
15. Suspension, termination, and account deletion
You may stop using the Services at any time and delete your account through the app.
We may suspend or terminate access for material or repeated violations of these Terms, unlawful conduct, security threats, or other legitimate reasons consistent with applicable law. Where appropriate, we will give notice and an opportunity to address the issue.
Account deletion removes account content as described in our Privacy Policy. It does not automatically cancel an outstanding order or ticket, resolve a payment dispute, or eliminate a refund right or legal obligation. Contact support about outstanding purchases before deleting your account so we can help you retain the information needed to resolve them.
Provisions that by their nature must continue after termination, including accrued payment obligations, intellectual property protections, and dispute provisions, will continue to the extent applicable.
16. Disclaimers and limits of responsibility
To the extent permitted by applicable law, the community features are provided on an “as available” basis. We do not guarantee uninterrupted access or the accuracy of member-generated content.
To the extent legally permitted, we are not responsible for indirect or consequential losses arising from use of the community features that were not reasonably foreseeable.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing removes mandatory consumer protections, product warranties, refund rights, or remedies relating to purchases from us.
17. Governing law and disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles, except where mandatory law requires otherwise.
Subject to applicable consumer protections and jurisdictional rules, disputes will be brought in the state courts located in Dallas County, Texas, or federal courts serving Dallas County, Texas, if those courts have jurisdiction.
If you are a consumer in a jurisdiction that gives you mandatory rights under local law or a right to bring proceedings in your local courts, these Terms do not take those rights away.
These Terms do not require arbitration or waive rights to participate in a class action. You are welcome to contact support@rootandharvest.app to seek an informal resolution, but doing so is not a condition of exercising your legal rights.
18. Changes to these Terms
We may update these Terms as the Services, business practices, or legal requirements change. We will post the updated Terms and revise the effective date. For material changes, we will provide reasonable notice and obtain renewed acceptance where required.
Changes will not retroactively alter completed purchases or accrued rights unless legally permitted and agreed where necessary.
19. General provisions
If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later.
These Terms and any specific purchase terms disclosed and accepted at checkout govern the relevant use or transaction. No provision overrides mandatory applicable law.
